Regulations for the provision of passenger transport services on a passenger ship “Odra Queen”

§1. Definitions

In this regulation, the following terms have the following meanings:

  • Terms: General Terms and Conditions for the Provision of Carriage Services on the Ship “Odra Queen”.
  • Agreement: Service Provision Agreement, which includes the Terms, concluded between the Carrier and the Passenger, acting directly or through authorized agents, representatives, or intermediaries.
  • Ticket: Document confirming the conclusion of the Agreement between the Carrier and the Passenger.

  • Passenger: Person using the Service based on the Agreement.
  • Disabled Person or Person with Reduced Mobility: A Passenger who is disabled or has reduced mobility according to Regulation (EU) No 1177/2010.
  • Baggage: Items under the control or possession of the Passenger.
  • Essential Medical Equipment: Medical and auxiliary equipment essential for Disabled Persons or Persons with Reduced Mobility.
  • Assistance Dog: Specially trained dog, marked and vaccinated, essential for Disabled Persons or Persons with Reduced Mobility, possessing a relevant training certificate and up-to-date vaccinations.
  • Valuables: Valuable items or documents, such as payment instruments, jewelry, etc.
  • Transport: Service of transporting persons and their baggage based on the Agreement.
  • Service: Service of transporting persons and their baggage, provided by the Carrier on the Ship based on the Agreement.
  • Fee: Price for Transport or Service.
  • Sailing Schedule: Schedule of the beginning and end times of Services on routes served by the Carrier.
  • Price List: List of Fees and other charges related to Services at individual ports on routes served by the Carrier.
  • Ship: Ship “Odra Queen” used by the Carrier to provide Services.
  • Force Majeure: External events beyond the Carrier’s control, such as wars, blockades, strikes, etc.

§2. General Provisions

  • The Terms constitute an integral part of the Agreements concluded by the Carrier during their validity period.
  • The Agreement and Terms are governed by the law of the Republic of Poland and international regulations, in particular Regulation (EU) No 1177/2010.
  • Summaries of the provisions of Regulation (EC) No 392/2009 and Regulation (EU) No 1177/2010 are annexed to the Terms.
  • Any disputes will be resolved by the competent common court in Szczecin, unless otherwise agreed.

§3. Agreement and Transport

  • The Carrier undertakes to perform the Service in accordance with the Agreement and Terms.
  • The person booking the Ticket must inform the Carrier about the needs of Disabled Persons or Persons with Reduced Mobility.
  • Passengers are required to comply with the instructions of the crew and ship regulations.
  • The Carrier reserves the right to refuse carriage of a Passenger or their Baggage in case of violation of the Terms or safety regulations.

§4. Reservations and Fees

  • Reservations can be made online, by phone, or in person at the Carrier’s office.
  • Fees for Transport must be paid within the period specified by the Carrier.
  • If a VAT invoice is required for the purchase of a ticket on-site, this fact must be reported before making the payment.
  • The fee for a ticket purchased on board can be paid in cash or by credit card.
  • The fee for a ticket purchased online can be paid by credit card, bank transfer, or through the quick payment system PayU.
  • A ticket purchased online is automatically sent after payment to the email address provided at the time of purchase, no later than one hour after payment confirmation.
  • The Passenger is obliged to present the online-purchased ticket in electronic form (on the screen of a mobile device) or printed on paper when boarding the ship.

§5. Refunds and Complaints

  • Refunds of fees are possible in accordance with the applicable provisions of Article 27 of the Act of May 30, 2014, on consumer rights.
  • Complaints should be submitted electronically to the address: info@odraqueen.pl.

§6. Baggage

  • Passengers have the right to transport a limited amount of Baggage without additional charge.
  • Carry-on baggage must be placed in designated areas on the Ship.
  • The Carrier is not responsible for valuable Baggage that has not been declared before boarding the Ship.

§7. Liability and Limitations

  • The Carrier’s liability for damages caused to Passengers is limited to the amount specified in the applicable regulations.
  • The Carrier is not responsible for damages caused by Force Majeure or actions of third parties.

§8. Rights of Passengers with Disabilities

  • The Carrier undertakes to ensure equal access for Disabled Persons or Persons with Reduced Mobility.
  • Passengers have the right to seek assistance in transportation and use Essential Medical Equipment.

§9. Changes in the Sailing Schedule

  • The Carrier reserves the right to make changes to the Sailing Schedule due to circumstances beyond its control.
  • In case of cancellation of the cruise, Passengers are entitled to a refund of the fee or the possibility of using another available service.

§10. Final Provisions

  • The Terms may be amended in accordance with the applicable provisions of law.
  • Matters not regulated by these Terms are governed by the provisions of Polish law.
  • These Terms come into force on April 1, 2024, and are valid until changes are made.

The regulations are legally binding for all passengers using transport services on the “Odra Queen” passenger ship.
